Terms of Service
These terms govern your use of Fitener ("the app"). By creating an account or using the app, you agree to them.
1. Who we are
The app is provided by Vanmaercke Wouter CommV, Tiegemberg 48, 8573 Tiegem, Belgium, company number BE 0726.677.280. Contact: hello@fitener.com.
2. Who can use it
You must be at least 16 years old and able to enter into a binding agreement. Fitener processes health data and is not designed for children. If we find that an account belongs to someone younger, we will close it and delete the data. Use the app only for your own personal, non-commercial fitness tracking.
3. Not medical advice
Fitener provides general fitness and nutrition information based on common training principles. It is not medical advice and is not a substitute for a doctor, dietitian or other qualified professional. Consult a physician before starting any training or nutrition programme, especially if you have a health condition, are pregnant, are taking medication, or are injured. You train and eat at your own risk.
Allergen and diet filters apply to Fitener's own recipe and ingredient library: a recipe or ingredient carrying an allergen you have selected is excluded from the plans we generate. Those filters do not extend to food you enter yourself, nor to packaged products looked up by barcode or by name: for those, composition data is supplied by a third-party database and may be altered by the manufacturer at any time, so we cannot warrant its accuracy or completeness. Always check the packaging of what you eat.
4. What the app does
The app builds rule-based training and nutrition plans from the information you provide, lets you log workouts and meals, and shows your progress. Plans are suggestions, not prescriptions. You decide what you actually do, and you can adjust every part.
5. Price
Fitener is free while it is in testing. The test version is handed out through Apple’s TestFlight. You are not charged for it, you do not buy a subscription, and there is nothing to cancel.
Fitener will become a paid app when it launches publicly in the App Store. At launch it will cost €39.99 a year or €5.99 a month, and both will start with a 14-day free trial. The subscription will then be bought through Apple’s App Store, and this section will describe how paying, renewing and cancelling work. Nothing is charged before you have seen those terms and chosen to subscribe.
You can delete your account yourself at any time from inside the app. You can download a copy of your data in the app, under Account, Privacy & data, or ask us for one by email. How long we keep data, and what happens to it when you delete your account, is in the Privacy Policy.
6. Your account and responsibilities
- Give accurate information: plans are only as good as the numbers you enter.
- Keep your sign-in and any device key secure; you are responsible for activity on your account.
- Do not misuse the app, attempt to break its security, or use it to harm others.
7. Connected services
You can optionally connect third-party services such as Withings and Apple Health. Your use of those services is governed by their own terms and privacy policies; we are not responsible for them. You can disconnect them at any time.
8. Availability
We work to keep the app running but cannot guarantee it is always available or error-free. Features may change, and we may suspend or discontinue the service. Where the app offers offline use, syncing still requires a connection.
9. Your content
The data you enter stays yours. You grant us only the limited permission needed to store and process it to provide the app, as described in the Privacy Policy.
10. Liability
To the extent permitted by law, the app is provided "as is" and we are not liable for indirect or consequential loss, or for injury or health outcomes resulting from your training or nutrition choices. Nothing in these terms limits liability that cannot be limited under Belgian or EU consumer law.
11. Termination
You can stop using the app and delete your account at any time from within the app. We may suspend accounts that breach these terms.
12. Governing law
These terms are governed by Belgian law, and disputes fall under the competent Belgian courts, without affecting the mandatory consumer protections of your country of residence in the EU.
13. Changes
We may update these terms; we will update the date above and, for material changes, notify you in the app. Continued use after a change means you accept the updated terms.
